This Privacy Policy applies to PI GATES online platform (the “Website”) and associated application (the “Application”) (the “Platform” refers jointly to the Website and the Application).

The Platform is operated by PI GATES. The terms “We” or “PI GATES” refer to the operator. For more information on how to contact us, please see Section 8 of this Privacy Policy.

We take your privacy very seriously. All personal data will be collected, stored and used by us in accordance with the European Union’s General Data Protection Regulation 2016/679 (“GDPR”), and/or any other applicable statutory regulations. vigor.

2. Why and how do we collect and use your personal data?

2.1. To allow you to use the Platform, to allow us to provide our services and to apply our T&Cs

We collect and use your personal data to enable you to use our Platform, provide our services and enter into a contract (GCU) with you, and in particular to carry out commercial transactions via the Platform, use the electronic payment system or leave reviews and communicate with other members. In order to use these services, you must have a PI GATE account. For this purpose, you must register as a member on the Website or the Application.

We need most of your personal data to enter into a contract (GCU) with you. In the event that you do not provide us with this personal data, we will not be able to enter into and perform a contract (GCU) with you. We need some of your data in order to be able to meet our legal obligations when you are a member of our Platform. In the event that you do not provide us with this personal data, we will not be able to comply with legal requirements and provide our services.

This data is also used to improve the Platform so that we can offer a better experience to our members (see 2.2.12).

We collect and use your personal data for these purposes until your PI GATE account is deactivated or for 5 years from the time your account becomes inactive.

2.1.1. To allow you to register on the Platform

When you register as a member on the Platform, you must provide the following data in order to complete the registration procedure and access your PI GATES account:

  1. Username (required when signing up without a Facebook or Google account);
  2. E-mail address ;
  3. Confirmation of majority;
  4. Password (required when registering without a Facebook or Google account);
  5. Registered company name (only when you are a Professional User);
  6. Type of company (only when you are a Professional User);
  7. SIRET number (only when you are a Professional User);
  8. If applicable, VAT registration number (only when you are a Professional User);
  9. Company address (only when you are a Pro User);
  10. Contact details (only when you are a Pro User);
  11. Contact email address (only when you are a Pro User);
  12. Full name of the legal representative (only when you are a Pro User);
  13. Date of birth of the legal representative (only when you are a Pro User);
  14. Nationality of the legal representative (only when you are a Pro User);
  15. Country of residence of the legal representative (only when you are a Pro User);
  16. Address of the legal representative (only when you are a Pro User).

The legal basis for the collection and use of data is the execution of a contract (CGU) to which you have subscribed or the taking of measures, at your request, before the conclusion of the contract (CGU) (art. 6 ( 1) (b) GDPR).

The legal basis for the collection and use of data provided by a Pro User is the performance of a contract (PI GATE Pro User Terms of Service) to which the Pro User has subscribed (Art. 6 (1) (b) GDPR).

We also determine your location (country) based on your IP address at the time of registration to display it on your profile. You can at any time choose to change your location (country, city or region) and make your city or region not visible to other members in the “My settings” section of your PI GATE account.

We collect and use your personal data for this purpose until your PI GATE account is deactivated or for 5 years from the time your account becomes inactive.

2.1.2. In order to authenticate you via Google, Facebook or Apple ID

If you sign up using your Google Ireland Ltd. (Ireland), Google LLC (USA) (“Google”), Meta Platforms Ireland Ltd. (Ireland), Meta Platforms, Inc. (US) (“Facebook”) or Apple Inc. (US) (“Apple”), or if you later choose to link your Google, Facebook or Apple account to your PI GATE account, you will be transferred from our Platform to the Facebook, Google or Apple website and prompted to enter your Facebook, Google or Apple ID account login information.

If you enter your Google login information, PI GATE will receive the following data from Google relating to your Google account (you can choose not to provide certain data):

  1. Profile picture ;
  2. First and last name ;
  3. Google Account ID;
  4. E-mail address.

If you enter your Facebook login information, PI GATES will receive the following data from Facebook relating to your Facebook account (you can choose not to provide your email address):

  1. Profile picture ;
  2. First and last name ;
  3. E-mail address ;
  4. Facebook account ID.

If you enter your Apple ID login information, PI GATES will receive from Apple the following data related to your Apple ID account (you can choose not to provide your email address using the Private Mail Relay Service from Apple):

  1. First and last name ;
  2. E-mail address ;
  3. Apple Account ID.

The data we obtain from Facebook, Google or Apple will be used to set up your PI GATES account. This means that we will use the member name of your Facebook, Google or Apple ID account as the member name for your PI GATE account, so that it is visible to other visitors to the Website and users of the Application. No one will have access to other data obtained from Facebook, Google or Apple on the Platform.

2.1.3. To allow you to configure your profile information

If you choose to add information to the profile of the account you create on the Platform, we collect and use the following data, subject to your consent to provide it:

  2. Gender;
  3. Date of birth ;
  4. Profile picture ;
  5. The metadata related to the photo you upload (geolocation, device identification number, date and time of the photo taken, etc.;)
  6. Holiday mode activation/deactivation;
  7. Your favorite items;
  8. Information you choose to provide in the “Profile” field.

Your profile picture, Vacation Mode activation/deactivation information and information you provide in the “Profile” field are visible to other Platform visitors, but other data entered by you is not visible .

Your consent is the legal basis for such collection and use (Art. 6 (1) (a) GDPR).

We collect and use your personal data for this purpose until your PI GATE account is deactivated or for 5 years from the time your account becomes inactive. Your photo’s metadata that contains personal data is immediately deleted.

2.1.4. To display relevant information about your activity on the Platform to other members

When you are a registered member of the Platform, we collect, use and make public on the Platform the following information, with the aim of providing other members with relevant information:

  1. Date of last login;
  2. Verification item;
  3. Number and member name of subscribers;
  4. Number and member name of tracked members;
  5. Number of “likes”.

Our legitimate interest in ensuring that our members have access to important information about each other forms the legal basis for such collection and use (Art. 6 (1) (f) GDPR).

We collect and use your personal data for this purpose until your PI GATE account is deactivated or for 5 years from the time your account becomes inactive.

2.1.5. To allow you to put your items on sale

If you list items for sale on the Platform, we will collect and use the following data for the purpose of creating, publishing or removing advertisements on the Platform (the list of information required differs depending on the category chosen for the item) :

  1. Title of the article (Service or Product);
  2. Item Description (Service or Product);
  3. Category of the article;
  4. Item brand;
  5. Item pictures;
  6. Item number;
  7. Metadata related to the photo you upload (geolocation, device identification number, date and time of the photo taken, etc.;)
  8. Price ;
  9. Delivery ;
  10. Delivery options.

Your consent is the legal basis for such collection and use (Art. 6 (1) (a) GDPR).

The personal data collected and used for this purpose is kept for 18 months and 7 days from the moment your account becomes inactive. Photos are kept for 3 months after the item is deleted. Your photo’s metadata that contains personal data is immediately deleted.

2.1.6. To activate your notifications on the Platform

When you are a registered member of the Platform, you may receive notifications on the Platform about your new subscribers, favorite posts, forum activity and other important messages.

The execution of a contract (CGU) to which you have subscribed constitutes the legal basis for the collection and use of the data (Art. 6 (1) (b) of the GDPR).

If you interact with a Pro User, your personal data for this purpose will be processed jointly by PI GATES and the Pro User. PI GATE is responsible for collecting personal data and transferring it to the Pro User. Please see Section 4 of this Privacy Policy for more information on joint control.

We collect and use your personal data for this purpose until your PI GATES account is deactivated or for 5 years from the time your account becomes inactive.

2.1.7. To enable you to communicate with other members

If you communicate with other members of the Platform, we collect and use the following data:

  1. Name of the member with whom you are communicating;
  2. Posts;
  3. Date and time of messages;
  4. Shared photos;
  5. Your device;
  6. Information on whether or not another member has seen your message;
  7. Other data indicated in the messages.

The execution of a contract (CGU) to which you have subscribed constitutes the legal basis for the collection and use of the data (Art. 6 (1) (b) of the GDPR).

If you interact with a Pro User, your personal data for this purpose will be that processed jointly by PI GATES and the Pro User. PI GATE must process personal data so that the Pro User has a means of communicating with other members and can carry out its functions. Please see Section 4 of this Privacy Policy for more information on joint control.

We collect and use your personal data for this purpose until your PI GATES account is deactivated or for 5 years from the time your account becomes inactive.

If you decide to delete a message from a conversation, it will be instantly hidden from you and the recipient, then permanently deleted after 3 months from the time you deleted it. The legal basis for storing deleted message data is our legitimate interest in ensuring the security of our Platform and our members (Art. 6 (1) (f) GDPR).

2.1.8. To enable you to leave reviews for other members on the Platform

If you leave reviews for other members, PI GATE collects and uses the following data for the purpose of making it publicly available on the Platform:

  1. Notice ;
  2. Assessment ;
  3. Member name;
  4. Date and time of the notice;
  5. Response to Notice.

Your consent is the legal basis for such collection and use (Art. 6 (1) (a) GDPR).

You can modify or delete the opinions you have left for other members at any time.

If you interact with a Pro User, your personal data for this purpose will be processed jointly by PI GATES and the Pro User. PI GATES is responsible for collecting personal data and publishing the exam on the Platform. Please see Section 4 of this Privacy Policy for more information on joint control.

We collect and use your personal data for this purpose until your PI GATES account is deactivated or for 5 years from the time your account becomes inactive. Reviews are then anonymized.

2.1.9. In order to receive the opinions of other members

When you receive reviews from other members, we collect and use the following data for the purpose of making it publicly available on the Platform:

  1. Notice ;
  2. Assessment ;
  3. Member name;
  4. Date and time of the notice;
  5. Your response to the review.

The legitimate interest of our members and PI GATES in building trust between PI GATES members forms the legal basis for such collection and use (Art. 6 (1) (f) GDPR).

If you interact with a Pro User, your personal data for this purpose will be processed jointly by PI GATES and the Pro User. PI GATES is responsible for collecting personal data and publishing the exam on the Platform. Please see Section 4 of this Privacy Policy for more information on joint control.

We collect and use your personal data for this purpose until your PI GATES account is deactivated or for 5 years from the time your account becomes inactive.

2.1.10. To enable you to post in the forum and discuss with our community

The PI GATE forum allows our community to discuss and support each other by sharing experiences and advice. You can create new forum topics or post comments in our forum. We collect and use the following data that you voluntarily submit on the Platform:

  1. Your member name;
  2. Your picture ;
  3. Forum topics you have created;
  4. Your posts on the forum;
  5. Photos shared in your publication;
  6. The date and time of your publication;
  7. The total number of your publications on the Platform;
  8. Your device;
  9. The number of “likes” on your publication;
  10. The number of “Likes” left by you on the publications of other members;
  11. Your favorite forum topics.

If you choose to post anonymously, other members will not be able to see your member name/photo. However, the PI GATES team will still be able to see your identity.

Your consent is the legal basis for such collection and use (Art. 6 (1) (a) GDPR).

You can delete and edit your own forum topics and posts at any time.

Unless you delete your forum topics or posts earlier, we collect and use your personal data for this purpose until your PI GATE account is deactivated or for 5 years from the time your account becomes idle.

2.1.11. In order to be able to send you important information regarding the Platform

If you register on the Platform, we will send you emails and messages via the Platform’s messaging system for the purpose of providing you with important notices, for example information regarding changes to the T&Cs or Privacy Policy. privacy.

The execution of a contract (in accordance with the T&Cs) to which you have subscribed (art. 6 (1) (b) of the GDPR) and compliance with the legal obligations to which PI GATES is subject constitute the legal basis for the collection and use of data (Art. 6 (1) (c) GDPR).

2.1.12. To determine if you are a Professional User and inform you

We will notify you when we consider you a Professional User and ask you to register as a Professional User on the Platform or convert your existing account to a Professional User account. To this end, we will collect your Platform usage data and take your activity into account, in order to determine whether you are considered a Pro User in accordance with our criteria if your turnover exceeds €200 / month. , and/or if we see that you have a significant number of communication with buyer users on our platform that shows that you have a significant number of transactions that pass outside our platform,

If you send us a question, request or complaint, we will collect and use the following data for the purpose of providing you with the customer support services you request on the Platform:

  1. Information relating to your profile;
  2. Information on the use of the Platform;
  3. Transaction information;
  4. Delivery information;
  5. Communications;
  6. Age ;
  7. Gender;
  8. IP adress ;
  9. Session information;
  10. Article announcements, photos and videos;
  11. Requests;
  12. Other information submitted by you.

The type of information we collect may vary depending on your request.

The execution of a contract (CGU) to which you have subscribed constitutes the legal basis for the collection and use of the data (Art. 6 (1) (b) of the GDPR).

If you interact with a Professional User, your personal data for this purpose will be processed jointly by PI GATES and the Professional User. PI GATES is responsible for collecting personal data and transferring it to a Professional User. The data will be processed by PI GATES and the Professional User so that the problems are solved at each phase. Please see Section 4 of this Privacy Policy for more information on joint control.

In order to respond to your requests, PI GATES provides your data to service partners who provide customer support services.

The following service providers are established in France and in the European Economic Area, but to offer you all the features and services promised by PI GATES we had collaborators who are based outside the European Economic Area, so your data may therefore be shared with our customer support agents and partners outside the European Economic Area. In these specific cases, the personal data is protected by the service providers who undertake to comply with the EU standard contractual clauses for transferring the data, as approved by the European Commission.

If you buy and/or sell and/or trade items (Services or Products) on the Platform and are involved in a dispute with another member, we will collect and use your personal data, held by PI GATES, necessary for the resolution of the dispute.

We base such collection and use on a legitimate interest in settling disputes between our members and defending the rights and interests of PI GATES (Art. 6 (1) (f) GDPR) and, where applicable, compliance with legal obligations to which PI GATES is subject (Art. 6 (1) (c) GDPR).

The personal data collected and used for this purpose is kept for 1 year after the resolution of a dispute.

2.1.16. To temporarily keep your account deactivated

If you decide to deactivate your account, we will make reasonable efforts to ensure that it is no longer visible on the Platform and to limit the use of your personal data. For 3 months, it is still possible to restore your account if it has been accidentally or wrongfully deactivated or in case you change your mind and want to use the Platform again, as well as to take action in the event that someone someone else would have accessed your account and deleted it without your knowledge.

The legitimate right of PI GATE and our members to restore your account if necessary (Art. 6 (1) (f) GDPR) and, where applicable, compliance with the legal obligations to which PI GATE is subject constitute the legal basis for such storage of your data (Art. 6 (1) (c) GDPR).

Personal data is kept for this purpose for 3 months from the date of deactivation of your PI GATES account.

At the end of these 3 months, we will permanently delete your account on our Platform.

2.2. To improve your experience when using the PI GATES Platform

We collect and use your personal data in order to improve your experience when using the Platform, by allowing you to personalize your news feed and your search results, by providing you with relevant suggestions and by keeping your previous searches, sending you notifications, and otherwise making your use of the PI GATES Platform more enjoyable.

The specific applicable legal basis for collecting and using your data is described in each of the sections below.

2.2.1. To personalize your newsfeed and search results

We also personalize the article news feed by evaluating your preferences based on the following:

  2. Age ;
  3. Country ;

  7. Your preferences.

  1. Number of positive reviews;
  2. Information regarding the fact that the seller has items that are less expensive than 60% of similar items sold on the Platform (similarity is determined according to the category, quality of service or product sold).

We use the results to prioritize value-for-money items from trusted sellers when introducing items to new members, to increase the visibility of items uploaded by members who have chosen the same language as you and/or reside in the same country or region, articles added by new members or marked as favorites 3 or more times, and finally to show relevant articles on the Platform.

We collect and use your personal data for this purpose until your PI GATE account is deactivated or for 5 years from the time your account becomes inactive.

2.2.3. In order to offer you relevant articles

If you choose to create advertisements for articles on the Platform, we will collect and use the data you provide in the advertisement (see 2.1.5 above), by analyzing it, in order to offer members who consult your articles of other relevant articles or to offer members your articles likely to be of interest to them.

Our legitimate interest in improving the Platform and ensuring that our members receive relevant suggestions and search results forms the legal basis for such collection and use (Art. 6 (1) (f) GDPR).

We collect and use your personal data for this purpose until your PI GATE account is deactivated or for 5 years from the time your account becomes inactive.

2.2.4. To improve search results on the Platform

We collect and use data provided in advertisements (see Section 2.1.5 above) relating to items that do not contain seller information to improve search results, by assessing the relevance of certain items when a specific search keyword is used, and for relevant categories to be automatically suggested for new listings. For this we only use item listings that are not tied to any particular seller.

Our legitimate interest in improving the Platform and ensuring that our members receive relevant suggestions and search results forms the legal basis for such collection and use (Art. 6 (1) (f) GDPR).

PI GATES uses service providers who provide data analysis services to PI GATES.

We collect and use your personal data for this purpose until your PI GATES account is deactivated or for 5 years from the time your account becomes inactive.

2.2.5. To save your recent searches

We save your search keywords in order to help you find articles already searched on the Platform. We collect and use the following data for the purpose of providing information about newly added articles on the Platform, based on the keyword you previously used to search:

  1. Your search history (last keywords used to search);
  2. Date and time of your search;
  3. Number of newly added items.

The legitimate interest of our members and PI GATES to improve search results on the Platform forms the legal basis for such collection and use (Art. 6 (1) (f) GDPR).

You can delete your search history at any time.

Unless you delete your search history earlier, we collect and use your personal data for this purpose until your PI GATES account is deactivated or for 5 years from the time your account becomes inactive.

2.2.6. To help you get more attention to your ads

If you decide to place an order for additional services, for example to benefit from the functionalities of upgrading to a Professional Account and of “Going Forward” in order to offer more visibility to your articles (Services and products) on the Platform, we will collect and use the following data:

  1. Information relating to your profile;
  2. Additional Services that you have purchased;
  3. Items you have selected for additional services;
  4. Duration of additional services;
  5. Date and time of additional services you have purchased;
  6. Prices for additional services;
  7. payment information;
  8. Invoices;

The performance of a contract (your order for additional features under the TOS) to which you have subscribed constitutes the legal basis for the collection and use of data (Art. 6 (1) (b) GDPR).

To conclude a contract (CGU) with you, we will need your personal data. In the event that you do not provide us with this personal data, we will not be able to enter into and perform a contract (GCU) with you.

2.2.7. To notify sellers when you mark their items as favorites

If you mark an item (Service or Product) from the Platform as a favourite, PI GATES will notify the seller accordingly.

The legitimate interest of our members and PI GATES in facilitating sales on the Platform constitutes the legal basis for such collection and use (Art. 6 (1) (f) GDPR).

We collect and use your personal data for this purpose until your PI GATES account is deactivated or for 5 years from the time your account becomes inactive.

2.2.8. To allow you to follow other members

If a member to whom you are subscribed you can always consult their page with their articles (services and products) in your favorites.

Your consent is the legal basis for such collection and use (Art. 6 (1) (a) GDPR).

We collect and use your personal data for this purpose until your PI GATE account is deactivated or for 5 years from the time your account becomes inactive.

2.2.9. To improve our Platform

PI GATES is committed to providing you with the most powerful Platform available. When the platform is used, PI GATES collects information about the actions performed on it (button clicks, visit times, reading of notifications, other information relating to a particular case study) and other data described herein. We are always looking for ways to improve your experience using PI GATES. This is why we may invite you to take part in a survey and use your comments. For this purpose, we collect and use the following data:

In order to make the content available in the preferred language of our members, we have integrated an automatic translation solution into the Platform. We collect and use the following data, if you or other members want a translation:

  1. The information you provided in the “Profile” field and all the fields of your private or professional sellers account.
  2. Item descriptions;
  3. The opinions;
  4. The messages.

When you log in to the Website or Application, we collect and use the following data (log files), even if you are not logged in to the Website as a member:

  1. A photo/screenshot of your bank statement showing your recent debit(s) on PI GATES;
  2. A photo/screenshot of the detailed PayPal statement of the most recent PI GATES orders: the date, total amount, delivery address and full name of the account holder must be visible);
  3. Proof of address: This can be a utility bill no older than 3 months showing your name and current address (e.g. gas, electricity, water, landline, but not mobile), or a photo/screenshot of your bank statement where your billing address is visible;
  4. A photo of the credit card used to make your purchases on PI GATES (the photo must show the full name of the cardholder, the last 4 digits and the expiry date of the card);

2.5.4. To enable “Know Your Customer” (KYC) checks on our Platform

2.5.5. To carry out Politically Exposed Person (PEP) checks on our Platform

2.5.6. In order to make refunds

If an item (Product or service) you purchase (is never shipped or service never provided, arrives damaged or not as described and you make a complaint, we collect and use the data used to make a purchase for the purpose of a refund.

If you purchase an item from a Professional User, we collect and transfer your email address to the Professional User directly so that the Professional User can fulfill their obligation to issue you an invoice.

We must do this in order to meet our legitimate expectations which consist in providing the Professional User with the information he needs to comply with the legal obligation (to issue an invoice) to which he is subject (Art. 6 (1) (f) GDPR).

Your personal data for this purpose will be processed jointly by PI GATES and the Professional User. PI GATE is responsible for collecting personal data and transferring it to the Professional User. Please see this Privacy Policy for more information on joint control.

2.5.8. To maintain financial records

If you engage in buy-sell and/or other transactions when using the Platform, PI GATES will collect and use the following data in order to perform its accounting duties:

  1. Full Name ;
  2. Username ;
  3. Address ;
  4. VAT identification number (if applicable);
  5. Value and description of the goods and/or services provided.

This is necessary to comply with the legal obligations to which PI GATES is subject (Art. 6 (1) (c) GDPR).

Financial regulations oblige us to keep accounting documents that confirm transactions for 10 years.

2.6. To enable the delivery of items purchased on the Platform

In order to send marketing emails, PI GATES uses the services provided by our service provider partners, which may be based outside the European Economic Area. In this case, the personal data is protected by the service provider who undertakes to comply with the EU standard contractual clauses for transferring the data, as approved by the European Commission.

We collect and use your personal data for this purpose until your PI GATES account is deactivated or for 5 years from the time your account becomes inactive.

2.7.2. To personalize marketing messages

PI GATES will use the data used to register you on the Platform and those relating to your PI GATES account, data from your activity on the forum, your log files and other means to personalize the marketing messages and advertisements presented to you. .

With your consent, PI GATES will allow its advertising service partners to collect your IP address and/or mobile device identifier, place their cookies on your devices and then use this data to personalize advertisements to you. are presented. This means that with your consent, you will receive advertisements based on your interests and activity on the Platform. Namely, advertising service partners will collect and use the following data:

For this purpose, the information is collected by advertising service partners and is not stored by PI GATES.

2.7.7. To assess the effectiveness of promotional campaigns

Joint supervisory authority with Facebook

PI GATES operates a “followers page” on the Facebook social networking platform. Facebook and PI GATES are only jointly responsible for the processing of so-called “Page Statistics data” (Art. 26 (1), first sentence, GDPR) insofar as these data are used for the creation of what the it is called “Page Statistics and only for the phases of data collection from the PI GATE subscriber page to transmission to Facebook. With regard to the processing of other data, PI GATE and Facebook are separately responsible for data processing.

2.8.2. In order to provide information to the police and other state institutions

If we have reasonable grounds to suspect that you are involved in illegal activities, we will collect and use the necessary data from your profile data, data related to your activities on the Platform and data collected and used for security purposes in order to report them to the police and other state institutions.

PI GATES also provides the aforementioned data to the police and other state institutions when it receives requests for information regarding investigations carried out by these institutions.

If you have transactions through our payment service providers, we will collect and use your personal data held by PI GATES to the extent necessary to resolve a particular situation.

We transfer personal data to lawyers, assistant lawyers, notaries, bailiffs, auditors, accountants, debt collectors, consultants, translation agencies, IT service providers, insurance companies and archiving who provide services to PI GATES.

In addition, we share data within the PI GATES group. Data processed within the PI GATES group is transferred to PI GATES, Paris (France) to the extent necessary for the management of the PI GATES group.

PI GATES is legally required to provide personal and/or usage data to investigative, criminal or supervisory authorities, if and to the extent necessary to avoid risk to the public and for the prosecution of criminal acts.

Joint Control of PI GATES and Professional User – Basis of Agreement

Under this privacy policy your personal data for this purpose will be processed jointly by PI GATES and the Professional User and you are informed of the processing of data by PI GATES and the commercial account operators (” PI GATE Professional Users”), referred to as “joint controllers”. This means that PI GATE and PI GATE Professional users (Pro and Gold) are both responsible for complying with certain legal obligations when processing personal data as joint controllers. There is no joint control for all data processing, but only for certain purposes and certain processing steps,

In general, PI GATES Professional users and also individual seller users are all responsible for complying with the legal obligations of the GDPR. Although PI GATES and PI GATES Professional users agree to certain responsibilities that apply when we act as joint controllers, PI GATES is responsible for:

  • act as your point of contact (sentence 3 of Art. 26 (1) GDPR);
  • manage centralized communication with you regarding the rights relating to your data (Art. 15, 16, 17, 18 and 20 GDPR);
  • provide you with information on data processing (Art. 13 and 14 GDPR);
  • inform you of the basis of our agreement (sentence 2 of Art. 26 (2) GDPR), which we do in this section;
  • notify you of data breaches associated with high risks relating to your rights and freedoms (Art. 34 (1) GDPR), in the event that such a data breach occurs.

All other GDPR responsibilities are met by PI GATES and PI GATES Professional users . These other responsibilities generally do not relate directly to you as a data subject. Rather, they are general obligations of joint controllers, such as maintaining security measures and keeping a record of processing activities. With respect to data processing outside the scope of joint control, PI GATES and PI GATES Professional users and Retail Sellers on PI GATES are independently and separately responsible and the information provided in the this section are not applicable.

  • subject to compliance with statutory criteria, to receive the data you have provided in a structured, current and machine-readable form, and to transfer such data to another processor or, where technically feasible, to have them transferred by PI GATES (right to data portability);

7.2. How will we verify your request?
